Seatbelt Issues

Pennsylvania has enacted laws requiring drivers, front-seat passengers, and children under four years of age to wear seatbelts. 75 Pa. Cons. Stat. Ann. § 4581. Many cases arise where serious damages are suffered by an accident victim who is not wearing a seatbelt. In some of these cases, a person is ejected altogether from the vehicle. Many states have laws which allow a defendant to use the plaintiff's failure to wear a seat belt against them. Pennsylvania courts, however, will not admit evidence of failure to wear seatbelts in automobile accident cases. 75 Pa. Cons. Stat. Ann. § 4581. Of course, you should always use your seat belt for safety reasons as well as legal ones.
